Intellectual Property
For any business or individual, protecting product identity and original work is one of the most critical concerns. At Parmenter Law, we understand how damaging it can be to have another business or person profit by using your trademark or copyrighted property. As part of our comprehensive services to clients, our Intellectual Property Team will assist in securing trademarks and copyrights, as well as protecting them against infringement.
Trademarks
A trademark is a word, phrase, symbol, or design used by a business or individual to identify goods and services and distinguish those goods and services from those of another business or person. Trademarks can be legally registered to protect the proprietary rights of the trademark holder. A registered trademark gives the owner the ability to prevent others from using a similar mark. Trademarks are governed by federal law. Registration is processed by the United States Patent and Trademark Office (USPTO).
Our Team assists clients with trademark availability searches and trademark registration. We also help clients protect registered trademarks through cease and desist actions and dispute resolution when another person or business infringes on our client’s trademark rights. In addition, we negotiate licensing agreements if our client wishes to permit limited use of a trademark.
Our work includes many clients in the liquor industry, including breweries, wineries, distilleries, and manufacturers. Much of that work involves protecting product names.
Copyrights
Copyrights protect certain types of original works from being used by someone else for profit. Authors and artists in particular benefit from registering copyrights.
Federal law governs copyright protection. The United States Copyright Office administers the law. Copyrights are available for original works including literary, dramatic, musical, and artistic works. The protections extend to movies, computer software, and sound recordings as well. In order to protect a work against infringement, the work must be registered with the U.S. Copyright Office.
Our Parmenter Law Intellectual Property Team assists clients with copyright registration for original works. We also help clients protect against copyright infringement through cease and desist actions, as well as dispute resolution, when a business or individual violates our client’s copyright protection.
